LEVI’S® RED TAB™ MEMBER PROGRAM TERMS AND CONDITIONS (THE “PROGRAM”)

Effective as of: 1 April 2022

SECTION 1. OVERVIEW

These Program Terms and Conditions (“Terms”), along with the Levi Strauss (Thailand) Ltd (together with its affiliates and subsidiaries, “LS&Co.”) Terms of Use and Privacy Policy constitute an agreement between you and LS&Co. relating to your participation in the Program (“Agreement”). Please read these Terms carefully because they affect your legal rights. Upon enrollment in the Program you become a "Member" and will receive access to certain benefits at qualifying Levi’s® store locations, or online at www.levi.co.th in Thailand (“Membership”). The LS&Co. Terms of Use and Privacy Policy govern participation in the Program and LS&Co.’s use of personal information provided under the Program. In the event of a conflict between these Terms and the Terms of Use and/or the Privacy Policy, these Terms will prevail. If you do not agree with these Terms, do not participate in the Program.

SECTION 2. ELIGIBILITY

To participate in the Program, you must be at least 18 years of age. If you are under eighteen (18) years of age, you may only participate in the Program under the supervision of a parent or legal guardian who agrees to be bound by these Terms. LS&Co. may change these eligibility requirements at any time, with or without notice, and reserves the right to refuse Membership to any applicant for any reason, in its sole discretion.

SECTION 3. HOW TO ENROLL

Enrollment in the Program is free and optional by providing the required information, including setup of a qualifying password or entry of an existing password, at a qualifying Levi’s® store location in Thailand, or online at www.levi.co.th. Enrollment may also include an optional questionnaire. Upon registering for the Program, individuals will receive an email confirming that they are a Member. You represent that all information you provide during registration and throughout your participation in the Program is true and accurate, and you agree to update such information, as necessary to maintain its truth and accuracy.

SECTION 4. PROMOTIONS

Upon enrollment, Members will immediately be eligible for the following benefits, which are all subject to change at any time, and may immediately terminate upon Member’s disqualification from or voluntary removal from the Program:

 
  1. Points Redemption Program

    The Levi’s® Red Tab™ points redemption Program allows Members to earn and redeem reward Points, in accordance with the following terms and conditions.

     
    • How to Earn Reward Points (“Points”)

      Members can earn at least 1 Point for every THB spent when making purchase(s) in Thailand in participating Levi’s® stores, Levi’s stores in Central and Robinsons Department stores, the Mall Group Department stores and online at www.levi.co.th (together, the “Participating Retail and Online Stores”) with the Program. Start earning from min 1 THB spend, rounding down to the nearest point issued.

      Members will not be eligible to earn points on any purchase of gift vouchers.

      Members who purchase on www.levi.co.th will need to login to their member account to earn Points. Members who make a purchase at participating stores can verify their membership by providing their email and/or mobile phone number. Please note that it can take up to two weeks for Points earned to be credited to the Member’s account.

    • Redeeming Reward Points

      Once earned, the Points will appear on the Member’s account portal on www.levi.co.th. 100 Points is equivalent to 1 THB in value and can be used to offset your future purchases at Participating Retail and Online Stores. The Points can be applied to offset your next purchase amount (net purchase price including VAT, and excluding shipping fees for online purchases). The number of Points that will be applied to a purchase will either be the total amount of Points the Member owns, or if that exceeds the value of the purchase, then the number of Points equal in value to the price of the purchase. The Member cannot choose how many Points will be applied to offset a purchase. Where a purchase made wholly or partly using Points is returned for a refund in accordance with our returns policy, the Points portion of the purchase shall be refunded in the form of cash vouchers. Members should write to THenquiry@levi.com within 14 days of making a purchase to make a returns request.

      Points cannot be transferred to another person or account, or exchanged for cash. A minimum of 100 points are required for redemption at Participating Retail and Online Stores to offset your purchases. Points cannot be used in combination with a gift voucher for any online purchases.

      Points have a validity of 12 months (365 days) from the date of accrual. If for any reason you believe that there is a discrepancy regarding your Points balance, please contact us via email at THenquiry@levi.com.

    • Redemption Items

      Members can redeem their Points for selected items or events during promotional periods as determined by LS&Co. The scope, variety, and type of services and products that you may obtain by redeeming Points can change at any time.

  2. Member Tier Benefits

    There are three membership tiers available, depending on the amount a Member spends in a membership year. Please refer to the below table for further details on the benefits attached to each tier.

    1. All transactions referred to in the above table are limited to those made in a Participating Retail and Online Store.
    2. For the purposes of qualifying for a Membership tier upgrade, the Member must meet the relevant qualifying spend in a 12 month period.
    3. For the purposes of maintaining a Silver or Gold Membership tier, the Member must meet the relevant qualifying spend within a 12 month period from the date they qualified for that tier (“Membership Year”). Where a Gold Member fails to meet the relevant qualifying spend during the Membership Year to maintain Gold tier, then depending on the amount spent during the previous Membership Year, the Gold Member may be downgraded to either Silver or Blue tier, in accordance with the relevant qualifying spend required for those tiers.
    1. A Member may qualify for multiple Membership tier upgrades within a 12 month period if they make the relevant qualifying spends within those 12 months. (Eg. A Member may qualify for a Silver tier upgrade by spending 5,000 THB and then qualify for a Gold tier upgrade by spending a further 10,000 THB two months later. The Membership Year will then restart from the date the Member qualified for Gold tier.)
    2. The Silver and Gold Membership tier status each lasts for one Membership Year.
    3. All purchases that are returned for a refund will not be counted towards that Member’s qualifying spend.
    4. Members who enroll during their birthday month will be able to enjoy the Welcome Bonus Points and Birthday Bonus Points.
    5. All purchases that are transacted using cash vouchers will not be awarded Points for the portion of the purchase that was paid for using cash vouchers.
  3. Members only discount privileges

    Members may enjoy early access to sales and extra discounts for a prescribed period during Mid-Season and End-of Season Sales (both online at www.levi.co.th and at qualifying store locations), as notified by LS&Co from time to time at its discretion and on such terms as it sees fit.

    Members-only discount privileges cannot be used in conjunction with any other sales, discounts, promotions, codes, coupons and/or offers.

  4. Early access to promotional events and other promotional activity

    Members may receive early access to:

     
    1. Sale and/or promotional events conducted online at www.levi.co.th and qualifying store locations (as and when applicable); and
    2. Information on upcoming promotions and/or events.
  5. Exclusive invitations to VIP events

    Invitations to exclusive VIP events, as notified by LS&Co from time to time at its discretion and on such terms as it sees fit. All scheduled events may be cancelled or postponed upon notice.

SECTION 5. GENERAL TERMS OF PROGRAM

Limit of one (1) Membership per person. If there is a dispute regarding ownership of the Membership, the owner will be deemed to be the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Each Member is responsible for providing a correct email address, as well as updating his/her email address as necessary for use in connection with the Program. LS&Co. will send Program-related emails, including but not limited to the following: welcome email; recurring Membership status statements and/or updates etc. To not receive these emails, Member must cancel his/her Membership. These emails will be in addition to any Program marketing or brand marketing emails Member may have also subscribed to receive. LS&Co. may also send Program-related notifications via SMS. To not receive these notifications, Member must opt out of receiving them.

By signing up for the Program, Member will also be signed up to receive brand marketing emails. To not receive these brand marketing emails, click on the self-service unsubscribe link found in the footer of any brand marketing email, or follow the instructions listed in the Privacy Policy. To cancel a Membership, or for any other Program-related questions, please contact Customer Service at THenquiry@levi.com. Please note that the hours of operation are 9.00 a.m. to 6.00 p.m. (Closed Saturday to Sunday, and on public holidays). A Member is not required to make purchases to qualify for the Program. LS&Co. reserves the right, in its sole discretion, to prevent any individual from enrolling in the Program or to suspend and/or remove any Member from the Program for any reason, including suspected re-sellers and/or wholesales, or in the event of any suspected fraud, abuse, or misuse in connection with this Program. LS&Co. reserves the right to change, suspend, or terminate the Program or any of its associated Terms at any time and in any manner with or without notice. Any subsequent Terms supersede prior versions. Your continued participation in the Program constitutes your acceptance of any changes to these Terms. You are responsible for remaining knowledgeable of any changes to these Terms.

SECTION 6. NO WARRANTY

To the extent permitted by law, LS&Co. its respective subsidiaries, divisions, and affiliate entities, along with each such company’s respective officers, directors, employees, and agents make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to the Program or any products or services related to the Program or that the Program will be free from defects or viruses or that operation of the Program will be uninterrupted. You are solely responsible for any damage or injury resulting from your participation in the Program and/or redemption of any promotion.

SECTION 7. RELEASE OF LIABILITY

By agreeing to participate in the Program, Members release LS&Co., its parent and subsidiaries and affiliate entities, and their respective, directors, officers, employees and agents (the “Released Parties”) from all liability with respect to the Program or the misdirection or misuse of any promotion. By participating in the Program, Members hereby release the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, solicitor’s fees) relating to participation in the Program, use of the Program and its benefits, or agreement to these Terms.

SECTION 8. DISPUTE RESOLUTION AND ARBITRATION AGREEMENT

If any part of the Terms shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of the Terms.

Any failure by us to partially or fully exercise any rights or the waiver of any breach of the Terms by you, shall not prevent a subsequent exercise of such right by us or be deemed a waiver by us of any subsequent breach by you of the same or any other term of the Terms. Our rights and remedies under the Terms shall be cumulative, and the exercise of any such right or remedy shall not limit our right to exercise any other right or remedy.

Any claim arising out of, or relating to, the Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. No recovery may be sought or received for damages other than out-of-pocket expenses, except that the prevailing party will be entitled to costs and solicitor’s fees. In the event of any controversy or dispute between us and you arising out of or in connection with your participation in the Program, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, then the parties shall be free to pursue any right or remedy available to them under applicable law in the courts of that state where our office is located.

SECTION 9. TERMINATION

These Terms are effective unless and until terminated by LS&Co. or until you cancel your Membership. You may terminate this Agreement at any time by cancelling your Membership. LS&Co. also may terminate this Agreement at any time without notice, and accordingly may deny you access to the Program, if in its sole judgment you fail to comply with any term or provision of the Agreement. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

Updates to the Terms

We can update these terms at any time without prior notice in our sole discretion. If we modify these terms, we will post the modification on the www.Levi.co.th, which are effective upon posting. Continued participation in the Program after any modification shall constitute consent to such modification.

SECTION 10. GENERAL

This Agreement shall be governed by the laws of Thailand. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or of LS&Co.’s right to require strict observance of each of the Terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between you and LS&Co. relating to your use of and/or participation in the Program.
